Article 108

Classification of Violations

1. Violations of this law are classified according to the degree of risk they pose to the life, health, and physical integrity of road users, the obligation to provide special care and protection for persons with disabilities, the prevention of traffic accidents, and the impact of the violation on road safety, into the following categories:

(a) Category E1,

(b) Category E2,

(d) Category E4,

(e) Category S (antisocial driving behavior).

2. Each of the categories listed in subparagraphs (a), (b), and (c) of paragraph 1 is divided into two subcategories, as follows:

(a) Subcategory A, for which only an administrative fine is imposed, and

(b) Subcategory B, for which an administrative fine and an administrative measure are imposed.

3. Violations of this provision that indicate antisocial driving behavior are classified, in addition to the categories set forth in paragraphs 1 and 2, in Category S. For violations under the preceding sentence, in addition to the administrative fine and the administrative measure imposed based on the category and subcategory to which they are classified, an additional administrative measure shall also be imposed.

4. Category E4 includes violations that have significant implications for road safety. For violations falling under this category, the administrative fine and the administrative measure specified in the relevant provision shall be imposed.

(b) Some of these violations result in additional or exclusively criminal penalties imposed by the court, as specified in the relevant articles of this law.

5. For each violation falling under the same category and subcategory, the following administrative penalties shall be imposed:

(a) Category E1 violation: (aa) E1-A: an administrative fine of thirty (30) euros is imposed,

(ab) E1-B: The administrative fine specified for subcategory E1-A is imposed, along with the administrative measure of suspension of the driver’s license for ten (10) days. b) Category E2 violation: ba) E2-A: an administrative fine of one hundred fifty (150) euros is imposed,

(bb) E2-B: The administrative fine specified for subcategory E2-A shall be imposed, along with the administrative measure of suspension of the driver’s license for twenty (20) days. c) Category E3 violation: ca) E3-A: an administrative fine of three hundred fifty (350) euros is imposed,

(cb) For E3-B, the administrative fine specified for subcategory E3-A shall be imposed, along with the administrative measure of revoking the driver’s license and the vehicle registration for thirty (30) days, in accordance with paragraph 1 of Article 106, concerning the imposition of administrative measures.

(d) For Category S violations, in addition to the penalties imposed in accordance with subparagraphs (a) through (c), the administrative measure of revoking the driver’s license for forty (40) days shall also be imposed.

6. The specific provisions of this law list the violations that result not only in administrative penalties but also in criminal penalties, or that result solely in criminal penalties imposed by a court.
