Special Cases for the Revocation of a Driver’s License

1. If a motor vehicle was used as a means to commit a felony or a willful misdemeanor, the following shall be revoked by court order: the vehicle’s registration and license plates, as well as the driver’s license of the person who was driving the aforementioned vehicle, for a period of one (1) to ten (10) years, provided that the imposed sentence is imprisonment of at least three (3) months.

2. Anyone found in possession of or using a forged or altered driver’s license shall be punished with the penalties provided for in Article 216 of the Penal Code (Law 4619/2019, A’ 95), concerning forgery.

3. A driver’s license shall be revoked by court order if the investigation reveals that the license holder caused injury or death while driving the vehicle, in violation of the provisions of this law.

Specifically, the items mentioned above are deducted as follows.

(a) For a period of at least three (3) months and up to two (2) years, if the traffic accident resulted in serious injury to occupants of any vehicle or to a pedestrian.

(b) For a period of at least two (2) years and up to five (5) years, if death occurred as a result of the accident, including cases where death occurred at a later time following the accident and is causally linked to it.

In this case, the license is reinstated only after the driver has passed both the written and practical exams and provided that the driver at fault completes the current theoretical and practical training program for driver candidatesin accordance with Presidential Decree 51/2012 (A’ 101).

c) In the event of a repeat offense, the above privileges shall be revoked by court order for a period at least twice as long as that provided for in subparagraphs (a) and (b). In such a case, the court may also impose the penalty of permanent revocation of the driver’s license.

4. Any person caught driving a motor vehicle without a valid driver’s license, in addition to any other penalties provided for, shall be disqualified from obtaining a driver’s license of any class, by court order, for at least three (3) years, and for at least ten (10) years, if the driver caused a traffic accident resulting in serious injury or death.

5. Any person caught driving a motor vehicle while their driver’s license has been revoked for any reason shall, in addition to any other penalties provided for, shall, by court order, be deprived of the right to have their driver’s license reinstated for an additional three (3) years; and if they cause a traffic accident resulting in injury or death, the court may also impose the penalty of lifetime revocation of the license to operate any motor vehicle.
