Article 100
Licenses for Operating Agricultural and Construction Machinery
1. No one is permitted to operate agricultural or construction machinery unless they hold a valid driver’s license as required by law, or if such a license has been revoked.
2. Notwithstanding paragraph 1, special-category vehicles that have been classified as special tractors or as construction machinery — heavy-lift vehicles and that operate exclusively within port or airport facilities — may be driven by drivers holding a Class CE driver’s license, in accordance with Presidential Decree 51/2012 (A’ 101) or by drivers holding construction machinery operator’s licenses.
3. A violation is committed by anyone who operates an agricultural or construction machine without the required driver’s license, or when such a license has been revoked, revoked, or has expired, is classified as Category E4, and the offender is subject to an administrative fine of seven hundred (700) euros, or the on-the-spot revocation of their driver’s license for one (1) year, if they hold one, and the suspension of the vehicle’s registration for thirty (30) days. In addition to the above administrative penalties, anyone who drives a vehicle described in the preceding paragraph while their driver’s license has been revoked, for violations of this law shall be punished by imprisonment for up to one (1) year and a fine of at least two thousand (2,000) euros.
4. Any person who operates an agricultural machine or construction machinery without the required driver’s license, or when such license has expired, been revoked, or been suspended pursuant to subparagraph (c) of paragraph 7 and paragraph 8 of Article 46, subparagraph (a) of paragraph 4 of Article 98, and the present provision, as well as Articles 101 and 110, if they cause a traffic accident, resulting in serious bodily injury, significant damage to public infrastructure, or the death of a large number of people, the penalties set forth in subparagraphs (cc) and dd) of paragraph 1 of Article 290A of the Penal Code (Law 4619/2019, A’ 95), concerning dangerous driving, shall be imposed.
5. The offender is eligible to take the exams for the issuance of an (initial) driver’s license in accordance with paragraph 1, after the expiration of the period from the date on which they were caught driving without a license, provided they present proof of payment of the administrative fine.
