Braking of Construction Equipment

1. Construction machinery that is designed to reach speeds exceeding twenty-five (25) kilometers per hour must be equipped with two (2) independent braking systems. Subparagraphs (a) and (b) of paragraph 1 and paragraph 5 of Article 59, concerning the braking systems of motor vehicles, apply mutatis mutandis.

2. Construction machinery that, by design, cannot exceed a speed of twenty-five (25) kilometers per hour, may be equipped with only one (1) braking system, provided that this system also functions as a parking brake.

3. Violations of this provision by the person who puts the vehicle into service, as well as by the person who drives construction machinery that is not equipped with the wheel-locking system referred to in paragraph 1, or in which such system is not operational, shall be classified in category E2-B.
