Article 62

Braking of mopeds, motorcycles, and three-wheeled vehicles

1. Two-wheeled mopeds and motorcycles without a side basket must be equipped with two (2) braking systems, one (1) of which must act on at least the front wheel, while the other must act on at least the rear wheel. On a motorcycle with a side basket, a braking system acting on the basket wheel is not required.

2. Three-wheeled (3-wheel) mopeds must be equipped with either two (2) independent braking systems that act simultaneously on all wheels, or one (1) braking system that acts on all wheels and one (1) backup (emergency) braking system, which may be the parking brake.

3. The braking systems of mopeds and motorcycles are capable of slowing the vehicle down, until it comes to a stop, in a safe, quickly, and effectively, regardless of the vehicle’s load conditions or whether the road is uphill or downhill.

4. Three-wheeled vehicles shall be equipped with one (1) wheel-braking system, which, when operated by foot, acts on all wheels, one (1) parking brake system, and one (1) auxiliary (emergency) brake system, which may be the parking brake. The parking brake meets the requirements of paragraph 1(b) of Article 59.

5. Violations of this provision by the person who puts the vehicle into service, as well as by the person who drives a moped, motorcycle, or three-wheeled vehicle that is not equipped with a braking system as described in paragraphs 1 through 4, are classified as Category E2-B.
