Article 52

Blockage of a section of the road and sidewalk

1. The temporary or permanent occupation of a portion of the roadway with structures or obstacles is prohibited, particularly if such structures or obstacles obstruct traffic, the permitted stopping or parking of vehicles, or restricts the visibility of road users.

2. Notwithstanding paragraph 1, in exceptional cases or in low-traffic zones within residential areas or in land-based port zones, provided there is sufficient space, the occupation of a section of a road with temporary installations or obstacles may be permitted, subject to authorization from the competent local government agency or the competent port management and operating authority, following the consentof the competent police or port authorities, respectively. Special equipment for recording traffic measurements (traffic cones) as part of a traffic study, after notifying the competent police or port authorities.

3. Those who construct buildings in residential areas or carry out other projects and occupy the entire sidewalk in front of the building or project are required to construct an additional sidewalk or take other appropriate measures to ensure the safe passage of pedestrians.

4. When the occupation of a section of a road is permitted, it must be marked by the party occupying it in accordance with Article 13, regarding the marking of work being carried out on roads.

5. It is prohibited to occupy a sidewalk for any purpose other than that for which it was constructed, provided that such occupation obstructs pedestrian traffic, as well as the entry and exit of emergency vehicles or the provision of services to residents.

6. Violations of this provision are classified under Category E3-A.
