Vehicle Immobilization

1. If it is determined that the operation of a motor vehicle poses a danger to its occupants or other road users as a result of malfunctions, wear and tear, emissions, the addition of parts, or other illegal modifications, or due to the driver’s physical or mental condition, law enforcement officers may immobilize the vehicle until the conditions for its safe operation and movement are ensured.

Law enforcement officers may order any road vehicle to be stopped during quiet hours and within residential areas if its operation causes excessive noise.

The immobilization of a vehicle pursuant to paragraph 8 of Article 2 of Law 4388/2016 (A’93) is carried out in accordance with paragraph 12 of that article.

2. A violation committed by a driver who refuses to comply with a police officer’s instructions to stop his or her vehicle, or by a driver who operates a vehicle that has been ordered to stop, pursuant to paragraph 1, is classified as Category E3-B and is punishable by imprisonment for up to one (1) year.
