Article 40
Rules for the Use of Vehicle Lights
1. At night, drivers are required to have their vehicle’s lights on and to use them as follows:
a) Headlights must not be turned on when the road is sufficiently lit—both within residential areas and and sufficiently and continuously outside residential areas to allow the driver to see clearly from a distance of at least one hundred (100) meters, as well as when the vehicle is stopped or parked.
(b) Driving lights must not be turned on, or, when they are turned on, their operation must be adjusted in such a way as to prevent glare, in the following cases:
(aa) When the driver is about to encounter an oncoming vehicle, any headlights that are on must be turned off or adjusted so as to prevent glare for a sufficient period of time, and the turn signals must be turned on instead, so that the driver of the other vehicle can proceed easily and safely.
(bb) When a vehicle is following closely behind another, the headlights may be used in accordance with paragraph 4 to signal the intention to pass, as provided for in Article 41 regarding audible and visual warnings.
(c) In any other case, where it is necessary to prevent the glare of other users of the same road, or of those using another road, waterway, or railroad line running parallel to it.
(c) Headlights must be turned on both inside and outside residential areas where the use of parking lights is prohibited.
(d) Parking lights must be used, except in the cases specified in Article 39 regarding the rules for the use of parking lights, in conjunction with headlights, turn signals, and fog lights. When stopping or parking, either the parking lights or the parking lights may be turned on.
2. If fog lights are installed, in accordance with Article 73, they must be used only in the event of fog, snowfall, or torrential rain, either alone or in conjunction with the intersection lights. These lights may be used on narrow, winding roads even if the above conditions do not apply.
3. With the exception of the cases provided for in paragraph 3 of Article 41, the following are prohibited when encountering an oncoming vehicle: turning the headlights on and off or alternating their use at short intervals.
4. The lighted warning referred to in paragraph 3 of Article 41 consists of turning on the intersection lights, flashing at short intervals, or the flashing of the running lights, or the alternating flashing of the intersection lights and the running lights, also at short intervals.
5. Violations of this provision are classified in category E1-A, with the exception of paragraph 1(b), which is classified in category E3-B.
