Article 39
Rules for Using Position Lights
1. Motor vehicles on the roads, with the exception of two-wheeled motorcycles without a sidecar, must have, at night and whenever visibility is insufficient, at least two (2) white or specially selected yellow parking lights at the front and an equal number of red parking lights at the rear, in accordance with Articles 69, concerning position lights (small), and 70, concerning clearance lights and side lights. In a combination of a motor vehicle with one (1) or more trailers, the red position lights must also be mounted on the rear of the last trailer. Trailers whose width exceeds one meter and sixty centimeters (1.60) must have the two (2) white side marker lights specified in Article 69 illuminated at the front.
2. Vehicles or combinations of vehicles to which paragraph 1 does not apply must have at least one (1) white or specially selected yellow light illuminated at the front and at least one (1) red light illuminated at the rear during nighttime. If there is only one (1) light at the front and one (1) light at the rear, it must be positioned on the centerline of the vehicle or on its left side.
3. At night and whenever visibility is poor, the presence of motor vehicles and trailers that are stopped or parked must be indicated by their front and rear position or parking lights. Exceptions:
(a) Vehicles that are stopped or parked on a well-lit street,
(b) two-wheeled bicycles, two-wheeled mopeds or two-wheeled motorcycles without a basket, which are stopped or parked at the edge of the roadway in a residential area and are not equipped with a battery (battery),
(c) vehicles that are stopped or parked in designated areas off the roadway and
(d) vehicles that are stopped or parked on streets in residential areas with minimal traffic.
4. The lights specified in paragraph 1 must be capable of making the vehicle’s presence apparent to road users.
During daylight hours, moped and motorcycle riders must ride with at least one (1) front running light and one red taillight turned on.
The front and rear lights must not be emitted by the same lamp or device, unless the vehicle’s characteristics—particularly its length—allow it.
5. Motor vehicles whose length does not exceed six (6) meters and whose width does not exceed two (2) meters, and to which no other vehicle is attached, are permitted, when stopped or parked on a street in a residential area, to have a side light illuminated on the side facing the direction of traffic. This light must be white or yellow at the front and red or yellow at the rear.
6. No vehicle may be equipped with red lights, red reflective devices, or red reflective materials at the front, and white or optional yellow lights at the rear, white or specially selected yellow reflective devices, or white or specially selected yellow reflective materials.
The preceding paragraph does not apply to the use of white or specially selected yellow reverse lights, nor to the reflection of light-colored numbers or letters on the rear identification plates or other distinguishing marks, as provided for and described in Chapter E. Furthermore, it does not apply to the reflection of the light-colored characters on the aforementioned plates or markings, nor to the red lights of certain emergency vehicles that rotate or flash.
7. Drivers of road and rail vehicles operating at night are required to ensure that their rear license plate is illuminated so that its details can be easily identified.
8. On horse-drawn vehicles and handcarts, the device that emits light may be carried by the driver or by an attendant walking on the left side of the vehicle.
9. Groups of pedestrians led by a person designated for that purpose or forming a procession, as well as herders of livestock or draft animals, or riders, who are moving along the roadway at night, are required to have, on the side where traffic is flowing, a reflective device or a (1) at least one white or specially selected yellow light illuminated at the front and one red light at the rear, or a yellow light at both of the aforementioned points. These lights may also be emitted by the same device. This provision does not apply in a residential area that is sufficiently lit.
10. Excluded from this article are strollers for infants and persons with disabilities, as well as other small non-motorized vehicles that are pulled or pushed by pedestrians, unless they are in use at night outside a residential area, in which case they must be equipped with white or yellow reflective elements.
11. No vehicle may be equipped with lights of a color other than those specified herein as applicable.
12. Violations of paragraphs 1 through 11 are classified in category E1-A, with the exception of the violation of paragraph 7, which is classified in category E1-B.
