Article 37

Passenger Transportation by Vehicle

1. It is prohibited to transport passengers in road vehicles in a manner that endangers the passengers themselves, the vehicle, the driver, third parties, animals, or property.

2. In particular, the following are prohibited:

(a) Transporting passengers in excess of the maximum number of passengers specified in the vehicle’s registration certificate.

(b) Children under the age of twelve (12) sitting in the front passenger seat, unless they are secured with an approved restraint system appropriate for their age, height, and weight.

(c) Occupying the seat next to the driver by more people than are permitted in that seat or those seats.

(d) Transporting a passenger on a motorcycle or moped:

(da) in a seat other than the passenger seat,

(db) if the person is unable to rest on their feet,

(dg) in the case of children up to five (5) years of age who are not secured using an approved restraint system appropriate for their age, height, and weight.

3. Drivers of motor vehicles and mopeds are required to ensure the safety of their passengers and, in particular, to verify that they are wearing seat belts and protective helmets while being transported.

4. a) Violations by the driver under paragraphs 1 through 2, subject to subparagraph b), are classified in category E1-B.

(b) Violations of paragraph 2(b), which concern children under the age of twelve (12) sitting in the front passenger seat, provided they are not secured by an approved restraint system appropriate for their age, height, and weight, and those under subparagraph (c) of paragraph 2, are classified in category E3-B.

(c) Violations of paragraph 3 regarding seat belts are classified as Category E2-B; violations regarding the passenger’s protective helmet are classified as Category E3-B.
