Rules of the Road
1. Anyone using the road network must avoid any behavior that may pose a danger or obstruct traffic, endanger people or animals, or cause damage to public or private property. Drivers are required to drive prudently and with constant vigilance, to pay special attention to children, the elderly, people with disabilities, and, in general, to those who need assistance; and, in general, not to cause, through their behavior, fear, anxiety, or harassment to other road users, pedestrians, or nearby residents.
2. It is prohibited to place, abandon, or discard any object or material on the streets if it obstructs, even minimally, the movement of pedestrians and vehicles, as well as the parking of vehicles.
It is prohibited to spill substances or materials—such as water, oil, and lime—onto the streets, as they can make the road slippery.
3. It is prohibited to throw any object out of a vehicle, even if doing so does not pose a danger or obstruct traffic.
It is prohibited to throw any object or substance from the vehicle that could cause a fire or pollute the environment.
4. If road users cannot avoid creating an obstruction or hazard, they are required to immediately take the necessary measures to remove or prevent it, and, if they are unable to do so, they must notify other road users of the existence of the obstruction or hazard.
Those who, for a valid reason—such as transportation, boarding, or alighting—wish to temporarily occupy a portion of the sidewalk or roadway, must take the appropriate measures to ensure the unimpeded and safe movement of pedestrians and vehicles.
5. The use of seat belts is mandatory for both drivers and passengers. When transporting minors, if there is an accompanying adult in the vehicle, that person is responsible for their safety. When transporting children by car, the use of special restraint and safety devices, such as child seats and seat belts, is mandatory.
6. Drivers and passengers of mopeds, motorcycles, and three-wheeled vehicles that do not have a canopy are required to wear a properly fastened protective helmet.
7. Drivers must treat pedestrians and other drivers with courtesy. Drivers of public passenger vehicles (E.D.X.) as defined in paragraph 19 of Article 4, as well as drivers of public transportation vehicles, including tour buses, must treat passengers with courtesy.
8. To familiarize students with the rules of the road, a course on this topic may be introduced.
9. It is prohibited to drive motor vehicles for the purpose of demonstrating skill, showing off, competing, or participating in impromptu races.
10. On both sides of the roadway of highways, it is prohibited to parking vehicles or setting up outdoor small shops or mobile and stationary kiosks for the sale of various items.
On the rest of the road network, the installation of the above is permitted, subject to a permit from the authorities responsible for road network maintenance, which is granted only after approval by the local traffic police departments.
11. (a) Violations of paragraphs 1 and 4 are classified in category E2-A. Violations of paragraph 5 regarding passengers’ failure to wear seat belts are also classified in the same category.
(b) Violations of paragraphs 2 and 6, regarding passengers’ failure to wear a protective helmet, are classified as Category E3-A.
(c) Violations of paragraphs 3 and 7 are classified under Category E2-A and Category S.
(d) Violations of the first and third subparagraphs of paragraph 5, which concern the driver’s failure to wear a seat belt and the failure to use special restraint and protection devices for transporting children, and of paragraph 6, regarding the driver’s failure to wear a protective helmet, as well as violations of paragraph 10, are classified in category E3-B.
(e) A violation of paragraph 9 is classified as Category E4, and the offender is subject to an administrative fine of two thousand (2,000) euros and the administrative measure of on-the-spot revocation of the driver’s license for one (1) year.
